Methodology
The Climate Litigation Database in Brazil was developed using JUMA’s own methodology designed with the objective of establishing common criteria that allow for the analysis of all lawsuits involving climate litigation in Brazil. The document, which contains the definitions, scope and principles that guided the collection and classification of cases, intends to provide the reader with the delimitation of the concepts used to build this database.
Climate Litigation in Brazil: the Climate Variable in Environmental Licensing
This database, organised by JUMA, contains the main numerical results (quantitative and qualitative) of the research “Climate Litigation in Brazil: Legal Arguments for the Inclusion of the Climate Variable in Environmental Licensing” (Categories A and C), carried out in 2020 and published in 2021 by Editora PUC-Rio.
Research Categories Present in this Database:
I. A survey and analysis of Brazilian legislation (federal, state and federal district) to establish the legal framework for the inclusion of the climate variable in environmental licensing (Category A).
II. A survey and critical analysis of foreign reference cases of climate litigation on environmental licensing (Category C).
